New Jersey Construction Worker Dies After Being Struck by Backhoe

Many construction and demolition projects depend on heavy equipment, such as backhoes, bulldozers and cranes. Without these machines, big jobs would be impossible, or much more time-consuming and costly. Unfortunately, the size and power that makes a piece of equipment so useful can also make it extremely dangerous when proper care is not used. 

During the demolition of a house on Mountain Avenue in Scotch Plains, a worker lost his life after being struck by the bucket of a backhoe. The victim was hit in the head while working on job for Americana Design. An OSHA investigation was launched as to the specific causes of the fatal accident. 

Heavy equipment accidents can occur for a variety of reasons, such as:

  • Operator error — Inexperienced or distracted operators may fail to control machinery properly, leading to accidents.
  • Inadequate training — Workers who are not adequately trained on the safe use of cranes, backhoes, bulldozers, forklifts or other types of construction equipment should be at the controls.  
  • Mechanical failure — Equipment malfunctions or lack of maintenance can result in dangerous situations.
  • Blind spots — Many large machines used in construction have large blind spots, increasing the likelihood of collisions with workers, fixed items or other machinery.
  • Poor communication — When heavy equipment operators are not on the same page as workers in the area, an accident might occur. 

To reduce the risks associated with heavy equipment, construction and demolition companies should implement robust safety measures. One key element of a safe site is detailed training on how to operate or work around heavy equipment safely. Machinery should be checked on a regular basis and recommended maintenance should be performed in a timely and thorough manner. Hand signals, radios and spotters can facilitate communication between operators and ground crews. Each site has unique features, so it is best to have a safety plan tailored to the particular conditions. 

When heavy equipment accidents occur, injured workers and their families may be entitled to workers’ compensation benefits. This coverage includes reimbursement for medical bills and a portion of lost income. Following a fatality, workers’ comp can also provide payment for funeral expenses and survivor benefits. If a negligent third party (not the victim’s employer or co-worker) contributed to the accident, additional damages might be available through a personal injury or wrongful death lawsuit.
