Sussex County Tort Claims Lawyer
New Jersey tort litigation attorney files lawsuits for negligent acts
If you have suffered injuries or other damages as the result of another’s negligence or other wrongful conduct, you might be entitled to compensation through a tort claim. Proving your injuries and how they were caused requires careful and thorough preparation. I am Kevin Kutyla, Esq., an experienced Sussex County tort claims lawyer. I will analyze your case, advise you of your viability of your claim and passionately fight for your interests in insurance negotiations and, if needed, in court litigation.
What is a tort claim?
A tort claim is an allegation that you have suffered a civil wrong. It is distinguishable from a contract claim because it arises from the general duty owed by people to act with reasonable care in their relations with others. A tort claim can be resolved through negotiation or may require litigation in court. I have a record of diligently pursuing tort claims in New Jersey in behalf of injured victims.
Types of tort cases
A tort can arise in one of three ways:
- Intentional acts — Examples include assault, if someone put you in reasonable apprehension of a harmful or offensive touching, or battery, if they completed such an act.
- Negligence — This means someone injured you by failing to exercise reasonable care. Examples include auto accidents, slip and falls and other types of personal injury.
- Strict liability — These are torts that can occur irrespective of the exercise of reasonable care. Examples include products liability, in which a manufacturer or seller is liable for injuries caused by defective products, even if they were unaware of the defect, and dog bite cases, in which a dog owner is liable for unprovoked dog bites even if they had no prior knowledge that the dog was vicious.
I pursue lawsuits for all manner of tort claims, working zealously to obtain just compensation for my clients’ injuries.
Proving a tort case in New Jersey
In order to win a tort case, you must demonstrate these elements:
- The defendant had some legally recognized duty toward you.
- The defendant breached that duty.
- The breach caused your injuries or other damages.
You must also prove the amount of damages you claim to be due. As an experienced civil attorney, I will make the strongest case possible and also work to overcome defenses raised.
How a Sussex County tort lawyer can help
As your attorney, I begin by analyzing the facts you relate and determining the viability of a tort claim. I gather the evidence necessary and whenever possible seek to obtain compensation out of court. If a lawsuit is needed, I conduct discovery to collect additional information and evidence. I also bring or contest any motions necessary to protect your rights. If, despite my best efforts, a fair settlement cannot be reached, I will vigorously present your case at trial.
Compensation for tort claims
Among the types of losses for which you might be entitled to compensation are:
- Medical bills
- Pain and suffering
- Loss of the enjoyment of life
- Lost income
- Lost future earning capacity
- Property damages
- Other expenses incurred because of the tort
- Loss of consortium (if your spouse was the injured party)
As a civil litigation lawyer, I will work to secure the maximum amount of compensation to which you might be entitled.
