What is civil litigation?
Civil litigation is a court proceeding that seeks to right a perceived wrong, obtain compensation for an injury or resolve a conflict. The parties to a civil case may be individuals, corporations or public officials or entities. In New Jersey courts, civil litigation is governed by statutes and by detailed court rules that require the assistance of an experienced attorney to navigate. Fortunately, you can count on me to represent you knowledgeably and skillfully throughout your case.
When to file a civil lawsuit in New Jersey
There are varied types of civil disputes that might require litigation to resolve. These include:
- Personal injury claims for an accident or other incident that injured you
- Wrongful death cases concerning the loss of a relative
- Fraud by an individual or business
- A business relationship gone awry
- Contractual disagreements
- Property disputes
- Employment disputes such as employment discrimination or wrongful termination
I am ready to review your situation, determine if anyone else is legally at fault and take appropriate measures to pursue just compensation and other relief.
The civil litigation process
Civil litigation begins with the filing of a complaint setting forth the plaintiff’s legal theory for recovery, the relevant facts and the remedies they seek. The defendant then files an answer, generally denying the allegations of the complaint and asserting any affirmative defenses. The parties then conduct discovery, in which each seeks information and documents from the other. Motions can be made by either party to aid discovery or for interim relief, such as injunctions while the case is pending. If the case isn’t settled or dismissed, a trial will be scheduled. Whether I represent the plaintiff or defendant, I pursue all means of resolution possible while zealously protecting my client’s interests.
